EACH TIME YOU USE THE SITE, THE CURRENT VERSION OF THE AGREEMENT WILL APPLY. GearGoats.com is not directed towards children under the age of 13 years old.
A) GearGoats Services. We currently provide you with access to a collection of deals from a variety of online stores and services through GearGoat's web site-based "Service". These offers are provided free of charge to the user, but companies whose deals we link to may provide a commissions for sales that we refer. GearGoats cannot guarantee the accuracy of the deals we link to as online merchants may discontinue an offer without prior notice or when supplies run out. GearGoats will monitor the deals and remove any that are determined to be inactive.
B) Service Limitations. We will do our best to make your visit with GearGoats a pleasurable and trouble free experience. However, we cannot always foresee technical difficulties that may arise. These difficulties may result in service disruptions. For this reason, you agree that the Service, including without limitation any Third Party Services (as defined in Section 12 below) are provided "AS IS." NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THIS AGREEMENT, OUR LIABILITY TO YOU IN RESPECT OF ANY LOSS OR DAMAGE SUFFERED BY YOU AND ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, WHETHER IN CONTRACT, TORT OR FOR BREACH OF STATUTORY DUTY OR IN ANY OTHER WAY SHALL NOT EXCEED $20.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS OF SECTIONS MAY NOT APPLY TO YOU.
You agree to indemnify and hold us, our subsidiaries, affiliates, and licensors and their respective officers, agents, partners and employees, harmless from any loss, liability, claim, or demand, including reasonable attorneys fees, made by any third party due to or arising out of the Contributions you post to this Site, your use of this Site and the Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth herein.

The User Agreement is governed by U.S. Federal law and the laws of the State of New York, U.S.A., without regard to its conflicts of law provisions; and you hereby consent to the exclusive jurisdiction of and venue in the federal and state courts located in New York, New York, U.S.A. in all disputes arising out of or relating to the Services. Use of the Services is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this Section.
E) Severability. If any part of the User Agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the User Agreement shall continue in effect.
F) Notices. Any notices related to this agreement need to be given in writing to one another at our address below, or any new address that is given in such a notice.
G) Non-Waiver. Our failure to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision.
H) Entire Agreement. This Agreement is the entire understanding between you and GearGoats.com about this Site and the Services and supersedes any prior or contemporaneous understandings and agreements between you and us related to the subject matter hereof.
I) Term, Termination and Survival. This Agreement shall remain in full force and effect while you use this Site. You may terminate your use or participation at any time, for any reason, by contacting us at [email protected]. Upon termination of your Site account for any reason, we will close your account, and you will no longer be able to retrieve materials contained in the account. Even after your use and participation is terminated, this Agreement will remain in effect, including sections: 1-12.
